Terms of Service

1. Agreement

These Terms of Service (“Terms”) are a contract between you and Kramer Ventures GmbH (“we”, “us”), Hagenholzstrasse 81, 8050 Zürich, Switzerland. They govern your use of the Photo Impostor mobile application, the photoimpostor.com website, and related services (together, the “App”). By installing or using the App you agree to these Terms and to our Privacy Policy, which explains how we handle your information. If you do not agree, do not use the App.

2. Who can play

You must be at least 13 years old to use the App. If you are under 18, you may use the App only with the permission of a parent or legal guardian who agrees to these Terms on your behalf. If you are under the age at which you can agree to these Terms where you live, you may not use the App. By using the App you confirm that you meet these requirements and that you are not barred from using it under any applicable law.

3. Your account

The App creates a guest account on your device, identified by a random ID and a key stored on your phone. There is no password. You are responsible for the device the account lives on and for everything done through it. If you delete the App or its data, the account and its statistics cannot be recovered. You can delete your account at any time in Settings → More → Delete account, which removes your profile, friends, statistics and stored uploaded photos. A copy of reported photo or clip evidence may be retained for up to 30 days for moderation.

4. License to use the App

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on a device you own or control, for your own non-commercial entertainment, in accordance with these Terms and the rules of the app store you got it from. You may not copy, modify, distribute, sell, rent, reverse engineer, or create derivative works of the App, use automated tools to access it, or try to get around any security or access controls.

5. Your photos and other content

You keep every right you have in the photos, videos, names, clues, reactions and other content you provide (“Your Content”). By approving a photo or clip for a game, or by agreeing to risky mode, in which the App sends photos from your library to the table without showing them to you first, you grant Kramer Ventures GmbH a worldwide, non-exclusive, royalty-free license to store, resize, process, and display that content to the players in that room for the purpose of running the game, to have a reduced copy of the secret photo processed by our AI service providers to produce the impostor's hint, and to review it if it is reported, as described in the Privacy Policy. This license ends when the game copy is deleted, which happens within 24 hours of upload; a copy of reported photo or clip evidence may be retained for up to 30 days for moderation.

You are responsible for Your Content. You confirm that you have the right to share it, including the permission of any other people who appear in it, and that it does not violate these Terms or any law. We do not claim ownership of Your Content, we do not use it for advertising, and we do not use your photos or videos to train AI models. To improve which photos the App offers, it may send us numeric summaries and details of the photos it offers you, never the photos themselves, as described in the Privacy Policy; you can turn this off in Settings.

Because the game is social, other players will see Your Content on their screens during a game and could take a screenshot of it. Share only what you would show in person.

6. Rules of the table

You agree not to:

• share photos, clips, names or clues that are sexual, hateful, harassing, violent, or that target, threaten or expose a real person;
• share intimate images of anyone, or images of people who would not want to be in a game;
• share content that infringes someone else's copyright, trademark, privacy or other rights;
• impersonate another person, or misrepresent who you are;
• spam, cheat, exploit bugs, interfere with other players' games, or attempt to access rooms, accounts or photos that are not yours;
• use the App for anything unlawful, or in a way that could harm Kramer Ventures GmbH, other players or the public.

Online rooms, once online play is available, include people you do not know. Play there as you would in a public place.

7. Moderation

You can remove or block a player from your friends list, and report any photo or player from inside a game. We review reports and may remove content, end a room, restrict features, or suspend or terminate accounts that violate these Terms, with or without notice. We may also do so where required by law or to protect players. We are not obligated to monitor content, but we may.

8. Photo Impostor+

Photo Impostor+ (“Plus”) is an optional, auto-renewing weekly subscription. It currently unlocks video and mixed rounds, risky mode, the full wardrobe of character parts and sticker packs, and planting one of your own photos as the secret, and you are not shown ads. When a Plus player is seated at a private table, the table can play video, mixed and risky rounds without anyone watching an ad.

Price. Plus is billed weekly at the price the App Store or Google Play shows for your country and currency. There is no free trial. The store shows the exact localized price before you confirm. Payment is charged to your Apple or Google account when you confirm the purchase.

Renewal and cancellation. The subscription renews automatically each week at the then-current price unless you cancel it. On the App Store, cancel at least 24 hours before the end of the current week; Apple charges for the renewal within the 24 hours before the period ends. On Google Play, cancel before the next renewal date shown in your subscription settings. You can manage or cancel it at any time in your Apple ID or Google Play subscription settings. Cancelling stops future renewals; you keep Plus until the end of the period you have paid for. Deleting the App or your Photo Impostor account does not cancel a subscription.

Restoring purchases. If you reinstall the App or move to a new device on the same store account, tap Restore purchases (in the Plus screen or in Settings). If Plus doesn't come back, write to us and we'll move it to your account. A subscription is tied to the store account and platform it was bought on and does not transfer between iOS and Android.

Purchases are made through Apple's App Store or Google Play and are subject to their terms. Refunds are handled by Apple or Google under their policies; we cannot issue refunds directly. We may change, add or retire Plus features over time; if we materially reduce what Plus includes, we will tell you in the App.

9. Ads and notifications

The App offers optional rewarded ads: you can choose to watch a short ad, for example to keep a character part or sticker pack, or to play a game with videos, a mixed game or a risky game, and you receive the reward when the ad finishes. Each kind of reward has a daily limit. The App shows no other ads. Photo Impostor+ subscribers are not shown ads. If you allow notifications (currently on iPhone), we send you a message when a friend invites you to a game, and remind you when your table is called to vote while the App is closed on your phone; you can turn notifications off at any time in your phone's settings.

10. Our content

The App, including its name, wordmark, characters, artwork, sounds, code and design, belongs to Kramer Ventures GmbH or its licensors and is protected by copyright, trademark and other laws. Nothing in these Terms gives you any right to use our name or marks. If you send us feedback or ideas, you agree we can use them without any obligation to you.

11. Third-party services and app stores

The App uses services from Apple, Google, and the providers listed in our Privacy Policy. Your use of the App through the App Store or Google Play is also subject to their terms.

The App links to our community on Discord and Instagram, which are run by third parties under their own terms. Opening one of these links from the App can unlock a community character (Gamer or Paparazzi). Joining or following is never required, and we do not check whether you do.

If you downloaded the App from Apple's App Store, you acknowledge that: these Terms are between you and Kramer Ventures GmbH, not Apple; Apple has no obligation to provide maintenance or support for the App; if the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any, and to the maximum extent permitted by law Apple has no other warranty obligation; Apple is not responsible for addressing any claims by you or a third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, or consumer protection claims; Apple is not responsible for investigating or defending any claim that the App infringes third-party intellectual property rights; you represent that you are not located in a country subject to a U.S. government embargo or designated as a terrorist-supporting country, and that you are not on any U.S. government list of prohibited or restricted parties; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Disclaimers

The App is provided “as is” and “as available”. To the fullest extent permitted by law, Kramer Ventures GmbH disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the App will be uninterrupted, error-free or secure, that rooms will always be available, or that any content shared by other players is accurate or appropriate. You use the App at your own risk. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

13. Limitation of liability

To the fullest extent permitted by law, Kramer Ventures GmbH and its owners, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising out of or related to the App or these Terms, even if advised of the possibility. Our total liability for all claims relating to the App will not exceed the greater of fifty U.S. dollars (US$50) or the amount you paid us in the twelve months before the claim arose. These limits do not apply to liability that cannot be limited by law.

14. Indemnity

You agree to defend, indemnify and hold harmless Kramer Ventures GmbH from any claims, damages, losses and expenses, including reasonable legal fees, arising from Your Content, your use of the App, or your violation of these Terms or of anyone's rights.

15. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access at any time if you violate these Terms, if required by law, or if we discontinue the App. Sections 5, 10 and 12 through 17 survive termination.

16. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules, and by applicable U.S. federal law. If you have a dispute with us, contact us first at support@photoimpostor.com and we will try to resolve it informally within 30 days. Any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in Delaware, and you and Kramer Ventures GmbH consent to their jurisdiction. You and Kramer Ventures GmbH agree to bring claims only in an individual capacity and not as a plaintiff or class member in any class or representative proceeding. If you are a consumer in a jurisdiction that gives you the right to bring claims in your local courts or under your local law, nothing in this section takes that right away.

17. General

These Terms, together with the Privacy Policy, are the entire agreement between you and Kramer Ventures GmbH about the App. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them to a successor of our business. We may update these Terms as the App changes; the date at the top shows the current version, and for material changes we will let you know in the App or on this page before they take effect. Continuing to use the App after a change means you accept the updated Terms.
